Mumbai: The Bombay High Court stayed the Maharashtra Medical Education and Drugs department's notification that allowed homeopathic doctors to practice modern medicine.
The state High Court came up with its stay decision after the Indian Medical Council (IMA) opposed the notification and approached the court in the said matter.
This notification issued on September 27, 2017, was challenged by the Indian Medical Association (IMA) through their lawyer S U Kamdar.
A bench of Justice Shantanu Kemkar and Justice Rajesh Ketkar questioned what about the risk to the patients.
"You may practise allopathy at your own risk, but what about the patients," the bench asked the lawyer representing homeopaths. They futher raised concerns about the risk to the patient's life in such a case.
Following the observations the court stayed the notification and posted the hearing after four weeks.
According to the notification, doctors who obtained the Licentiate of the Court of Examiners of Homeopathy (LCEH) degree from 1951-1982, and registered with the Maharashtra Medical Council (MMC) were allowed to practise modern, allopathic medicine. LCEH degree was recognised by Central Council of Homeopathy in 1951 and abolished by it in 1982. However such practitioners argued in the court that since they studied one subject of internal medicine as a part of their integrated course, they should be allowed to practice allopathy
The IMA had challenged the notification pointing out that the Indian Medical Council did not recognise such homeopathy degrees.
